Use OpenMindAI responsibly.

These website terms summarize the practical conditions around downloads, local AI execution and release information.

OpenMindAI Terms of Use and End User License Agreement

These Terms of Use and End User License Agreement govern access to and use of the OpenMindAI desktop and mobile applications, related local software components, optional online features, model-management functions, documentation, update services, websites, and support channels made available by OpenMindAI.

These Terms are intended to provide a clear contract between the user and OpenMindAI. They should be read together with the OpenMindAI Privacy Policy and any third-party license notices presented with the application, a model, a runtime, a library, or a connected service.

OpenMindAI is an independent software product. Availability of a third-party model, model family, runtime, API, library, or integration does not mean that OpenMindAI is owned by, sponsored by, endorsed by, or affiliated with the organization that created that third-party technology unless OpenMindAI expressly states otherwise.

These Terms are designed for a general-purpose AI application that may perform some processing locally on the user's device and may also offer optional network-enabled features. The actual capabilities available to a user can differ by operating system, hardware, application edition, model, region, distribution channel, permissions, and selected settings.

This document is a publication-ready legal template for OpenMindAI but does not replace advice from qualified legal counsel for every jurisdiction in which the application may be distributed. Mandatory consumer, privacy, intellectual-property, product-safety, accessibility, employment, education, and other laws remain applicable even when these Terms use broader contractual language.

Acceptance of These Terms

By downloading, installing, opening, accessing, or using OpenMindAI, the user agrees to these Terms to the extent permitted by applicable law. If the user does not agree, the user should not install or use the application and may uninstall it from the device.

If a user accesses OpenMindAI on behalf of a company, school, research institution, public body, nonprofit organization, or other entity, the user represents that the user has authority to accept these Terms for that entity or is using OpenMindAI under authorization granted by that entity. The organization remains responsible for its own policies, permissions, contracts, data-governance requirements, and regulatory obligations.

If a distribution platform, operating-system provider, application store, enterprise administrator, or device-management system imposes additional binding terms, those terms may also apply. Where those terms provide rights that cannot lawfully be waived, those rights are not reduced by this document.

Eligibility and Authority

Users must have the legal capacity required in their jurisdiction to agree to these Terms. Where a user is not legally able to form a binding agreement independently, use must occur with any consent, supervision, or authorization required by applicable law.

OpenMindAI is not designed to grant access to systems, data, devices, accounts, or services that the user is not already authorized to access. The user is responsible for ensuring that every file, account, API, website, codebase, network, device, document, database, camera, microphone, storage location, or other resource used through OpenMindAI is accessed lawfully and with appropriate permission.

Organizations deploying OpenMindAI to employees, students, contractors, researchers, or other users are responsible for determining whether the application is suitable for their environment and whether additional controls, policies, consent, logging, retention, security, or human review are required.

Scope of the OpenMindAI Service

OpenMindAI may provide functionality such as conversational AI, text generation, reasoning assistance, code assistance, document processing, image-related features, audio-related features, local model execution, model discovery or download, file analysis, search, optional online integrations, memory or history features, and other AI-assisted workflows.

Some capabilities may run entirely on the user's device. Other capabilities may require an internet connection or a third-party service. The interface should identify material differences where they affect privacy, cost, connectivity, model behavior, or data transmission.

OpenMindAI does not guarantee that every feature will exist on every platform. Desktop and mobile versions may differ because of hardware, operating-system restrictions, package size, battery constraints, model compatibility, application-store rules, or development priorities.

OpenMindAI may modify, add, remove, rename, restrict, or replace features when reasonably necessary for technical, legal, security, licensing, safety, performance, or product-development reasons.

Local and Offline Functionality

OpenMindAI is designed to support local or offline AI functionality where technically available. Local functionality can allow prompts, files, model inference, conversation history, preferences, or generated outputs to remain on the user's device rather than being sent to a remote AI provider.

Local processing does not mean that every OpenMindAI feature is always offline. Model downloads, application updates, web search, cloud integrations, external APIs, account services, support, external links, and similar features may require network access.

Users should review feature labels and settings before processing confidential or regulated information. If a selected feature sends information to a third party, that third party may process the information under its own terms and privacy policy.

Local AI models can consume substantial storage, memory, processing power, graphics resources, and battery capacity. Performance varies by device and model. OpenMindAI does not guarantee a particular speed, token rate, battery impact, memory footprint, or hardware utilization level.

License to Use OpenMindAI

Subject to these Terms and any license notice included with a particular release, OpenMindAI grants the user a limited, non-exclusive, revocable, non-sublicensable, and non-transferable license to install and use the application for lawful personal, educational, research, development, or business purposes.

This license applies only to rights OpenMindAI is legally able to grant. It does not replace or expand the license governing any third-party model, library, runtime, codec, framework, font, image, icon, dataset, API, service, or other external component.

The user may use OpenMindAI on devices the user owns or is authorized to control, subject to the rules of the distribution channel through which the application was obtained.

The user may not falsely represent a modified copy as an official OpenMindAI release, use OpenMindAI branding in a misleading way, remove legally required proprietary or attribution notices, bypass license enforcement where legally applicable, or distribute malicious software under the OpenMindAI name.

Nothing in these Terms restricts reverse engineering, interoperability research, security analysis, modification, redistribution, or other acts to the extent that such rights are expressly granted by an applicable open-source license or cannot lawfully be restricted under mandatory law.

Ownership of the Application

Except for third-party materials and any components released under separate licenses, OpenMindAI retains its rights in the application, branding, original documentation, original interface assets, product names, service names, and other materials created by or for OpenMindAI.

Downloading or purchasing access to the application does not transfer ownership of OpenMindAI intellectual property. The user receives only the rights expressly granted by these Terms, applicable law, and any separate license that accompanies a component.

Third-party names, logos, model names, product names, and trademarks remain the property of their respective owners. Their appearance in OpenMindAI may identify compatibility, model origin, integration availability, or technical information and does not by itself indicate sponsorship or endorsement.

User Content

User Content includes prompts, messages, files, documents, images, audio, code, configuration data, instructions, locally stored knowledge, and other information a user provides to OpenMindAI.

As between the user and OpenMindAI, the user retains the rights the user already holds in User Content. OpenMindAI does not claim ownership merely because content is processed by the application.

The user is responsible for ensuring that the user has sufficient rights and authority to provide User Content to OpenMindAI and to any selected third-party integration. This responsibility is especially important for confidential business data, personal data, copyrighted works, customer records, proprietary source code, academic material, medical information, financial records, trade secrets, and information received under a nondisclosure agreement.

Where a feature runs locally, OpenMindAI generally does not need a remote license to the User Content merely for local processing. Where a user intentionally selects a remote feature, the user grants OpenMindAI and any required service provider only the rights reasonably necessary to transmit, process, return, secure, and operate that selected feature, subject to the applicable Privacy Policy and third-party terms.

OpenMindAI does not grant the user new rights in third-party material contained in User Content. The fact that an AI model can read, transform, summarize, translate, analyze, or generate material related to a work does not mean the user has permission to publish, redistribute, or commercially exploit that work.

Generated Output

Generated Output includes text, code, summaries, images, structured data, recommendations, explanations, transformations, analyses, and other content produced with assistance from an AI model through OpenMindAI.

Rights in Generated Output may depend on applicable law, the model license, the source material, the user's contribution, the nature of the output, and third-party rights. OpenMindAI does not guarantee that Generated Output is eligible for copyright protection, exclusive to the user, original, unique, non-infringing, or suitable for commercial use.

Different users may receive similar or identical output. A model may reproduce common phrases, public-domain material, licensed material, patterns learned during training, or content that resembles protected works. Users are responsible for reviewing output before publication, sale, distribution, filing, deployment, or other consequential use.

Where a third-party model or service imposes additional terms on output, those terms apply to use of that model or service. OpenMindAI does not override third-party model licenses or service agreements.

Generative AI Disclosure

OpenMindAI contains or may contain generative AI features. Users should understand that they are interacting with software-generated content rather than a human expert unless the interface clearly states otherwise for a particular feature.

Generated content may be fluent and confident while still being inaccurate, incomplete, outdated, biased, unsafe, or fabricated. OpenMindAI does not guarantee factual correctness or professional reliability.

Users should disclose AI assistance when required by law, a platform, an employer, an educational institution, a research venue, a professional body, a customer contract, or another applicable policy.

Synthetic images, audio, video, or text involving real people should not be presented in a manner that unlawfully deceives others, impersonates another person, or falsely attributes statements, actions, or endorsements to a real person.

AI Accuracy and Hallucinations

AI models can generate hallucinations. A hallucination may include a fabricated fact, false quotation, nonexistent citation, incorrect command, insecure code pattern, fake legal authority, invented publication, inaccurate product specification, wrong mathematical result, or other unsupported claim.

The user must independently verify information when accuracy matters. The level of verification should increase with the potential impact of an error.

OpenMindAI may provide warnings, citations, search integration, retrieval features, confidence indicators, model metadata, or other tools intended to support verification. These tools reduce risk but do not eliminate it.

A response generated with web search or document retrieval can still misinterpret a source. The user remains responsible for checking the original source where important decisions depend on the result.

Professional and High-Impact Use

OpenMindAI is not a licensed medical professional, lawyer, accountant, financial adviser, tax adviser, engineer of record, emergency service, mental-health professional, or other regulated professional service.

Users may use OpenMindAI for general drafting, learning, brainstorming, organization, coding assistance, research support, or preliminary analysis, but should obtain qualified human review where an error could materially affect health, safety, legal rights, finances, employment, education, housing, insurance, public benefits, critical infrastructure, or another high-impact interest.

OpenMindAI should not be used as the sole decision-maker for consequential eligibility, disciplinary, hiring, lending, medical, legal, educational, immigration, criminal-justice, insurance, or similar decisions about a person where applicable law or responsible practice requires meaningful human review.

Users should not delay emergency services, medical care, legal deadlines, cybersecurity incident response, or other urgent professional assistance because of an AI-generated response.

Coding and Software Engineering Use

AI-generated code can contain vulnerabilities, outdated APIs, dependency mistakes, licensing conflicts, unsafe cryptography, injection risks, broken authorization logic, insecure file handling, memory-safety problems, or other defects.

Users are responsible for reviewing, testing, scanning, and validating code before deployment. Production use should include appropriate testing, code review, dependency management, secret management, authentication and authorization checks, input validation, logging, monitoring, backup, rollback, and security controls.

OpenMindAI does not warrant that generated code is production-ready, secure, compatible with a particular dependency version, free from intellectual-property issues, or appropriate for safety-critical systems.

Users must not use OpenMindAI to deploy malware, credential theft, unauthorized persistence, destructive payloads, ransomware, botnets, unlawful surveillance, or other malicious software.

Authorized cybersecurity testing, defensive research, vulnerability analysis, secure coding, incident response, education, and legitimate system administration are permitted when conducted lawfully and with appropriate authorization.

Research and Academic Use

OpenMindAI may assist with literature organization, explanation, drafting, coding, data analysis, formatting, brainstorming, or research workflows. Users remain responsible for research integrity.

Users must comply with institutional and publisher rules concerning AI assistance, authorship, attribution, disclosure, plagiarism, data management, reproducibility, ethics approval, and conflicts of interest.

AI-generated references must be independently verified. Users should not cite a publication solely because an AI model produced a plausible title, author list, DOI, quotation, or bibliographic entry.

The user is responsible for ensuring that confidential peer-review material, unpublished manuscripts, protected datasets, participant information, or restricted research data are not sent to a remote service without authorization.

Acceptable Use

OpenMindAI is a general-purpose tool. The user is responsible for using it lawfully and responsibly.

  • Do not use OpenMindAI to facilitate unlawful access to a computer, account, network, device, database, or service.
  • Do not use OpenMindAI to steal passwords, authentication tokens, payment credentials, identity documents, private keys, or other secrets.
  • Do not use OpenMindAI to create, distribute, or operate malware, ransomware, destructive code, credential-stealing software, or malicious persistence mechanisms.
  • Do not use OpenMindAI to facilitate exploitation or sexual abuse of children or any content or conduct involving child sexual abuse material.
  • Do not use OpenMindAI for non-consensual sexual imagery, sexual extortion, or the creation or distribution of intimate material without lawful consent.
  • Do not use OpenMindAI for stalking, unlawful surveillance, doxxing, targeted harassment, credible threats, or intimidation.
  • Do not use OpenMindAI to commit fraud, deceptive impersonation, identity theft, payment abuse, phishing, or other dishonest conduct.
  • Do not use OpenMindAI to materially facilitate unlawful weapons activity, terrorism, violent wrongdoing, or instructions intended to cause serious physical harm.
  • Do not use OpenMindAI to violate intellectual-property rights, confidentiality duties, privacy rights, trade-secret obligations, or contractual restrictions.
  • Do not use OpenMindAI to evade sanctions, export restrictions, court orders, law-enforcement requirements, or other binding legal obligations.
  • Do not intentionally interfere with OpenMindAI infrastructure, distribution services, update systems, support services, or security controls.
  • Do not intentionally submit content designed to compromise third-party systems or cause OpenMindAI to facilitate unauthorized harmful activity.

OpenMindAI may apply safeguards, warnings, feature restrictions, model recommendations, or access limitations where reasonably necessary for safety, legal compliance, platform compliance, or security.

Content Safety and Reporting

Generative AI systems can produce objectionable, harmful, inaccurate, biased, deceptive, or inappropriate content even when the application includes safety controls.

OpenMindAI may provide a mechanism for users to report AI-generated content, safety issues, abuse, security concerns, or policy violations. Reports may be submitted through the application where available or through the contact page at https://openmindai.vercel.app/contact.

Users should avoid including unnecessary personal or confidential information in a report. OpenMindAI may request enough information to reproduce or understand the issue, such as the model name, feature used, application platform, relevant prompt, output, and technical context.

OpenMindAI may use reports to adjust product safeguards, change default model recommendations, remove a compromised or unsuitable model from a catalog, modify documentation, improve user warnings, or take other appropriate action.

A reported output may come from a local third-party model rather than code authored by OpenMindAI. OpenMindAI will use reasonable efforts to distinguish application behavior from model behavior but cannot guarantee correction of a third-party model's underlying characteristics.

Third-Party AI Models

OpenMindAI may support AI models produced by independent organizations, open-source communities, research groups, companies, or other third parties.

Each model may have its own license, acceptable-use terms, hardware requirements, training history, limitations, safety behavior, context length, supported languages, redistribution rules, commercial-use restrictions, or other conditions.

Users are responsible for reviewing a model's applicable license before using it for sensitive, commercial, regulated, or redistribution purposes.

A model being available without a purchase price does not necessarily mean that all uses are unrestricted. OpenMindAI should distinguish between price, licensing rights, redistribution rights, and technical availability where practical.

OpenMindAI may stop recommending, listing, distributing, or supporting a model if its license changes, a security issue is discovered, the source becomes unavailable, a model is unsuitable for the platform, or continued distribution creates legal or technical risk.

If a user manually imports a model, OpenMindAI may not be able to verify its origin, integrity, license, safety tuning, or compatibility. Use of manually imported or modified models is at the user's own risk to the extent permitted by law.

Third-Party Software and Open-Source Components

OpenMindAI may include or depend on third-party frameworks, runtimes, libraries, codecs, drivers, tools, and open-source software.

Third-party components remain governed by their own licenses. Where a third-party license grants broader rights than these Terms, the third-party license controls for that component.

Where required, OpenMindAI should provide attribution, copyright notices, license text, source-code access, or other compliance information in the application, documentation, distribution package, website, or another reasonable location.

The user must not interpret a general OpenMindAI license statement as changing the legal terms of a third-party component.

Optional Third-Party Services

OpenMindAI may support optional services such as web search, cloud storage, remote AI providers, authentication services, external APIs, or other integrations.

Use of a third-party service may require a separate account, API key, subscription, payment method, consent, or acceptance of that provider's terms.

If the user supplies an API key or account credential, the user is responsible for maintaining its security and for charges, usage limits, suspension, or other consequences associated with that account.

OpenMindAI is not responsible for the independent availability, pricing, accuracy, security, privacy practices, moderation decisions, service limits, or policy changes of a third-party provider.

OpenMindAI may disable or modify an integration if the provider changes its API, terms, technical requirements, or access conditions.

Privacy

Use of OpenMindAI is also governed by the OpenMindAI Privacy Policy. The Privacy Policy explains how data may be processed locally, what information may be transmitted when the user selects an online feature, how permissions are used, how information may be retained, and what controls may be available to the user.

Privacy, support, security, and data-related requests may be submitted through https://openmindai.vercel.app/contact.

Users should review the Privacy Policy before processing sensitive information. A user who enables a third-party service should also review that service provider's privacy policy.

OpenMindAI intends to minimize unnecessary collection, but the user remains responsible for choosing appropriate settings and features for the sensitivity of the information being processed.

Device Permissions

Desktop and mobile operating systems may require OpenMindAI to request permissions before certain features can work.

Possible permissions can include access to files or storage, camera, microphone, photos or media, notifications, network connectivity, local folders, or other system resources depending on the platform and enabled feature.

A permission request does not mean OpenMindAI continuously uses that permission. Permission use should be tied to user-selected features where practical.

  • Camera access may be used when the user chooses an image capture, visual input, scanning, or related feature.
  • Microphone access may be used when the user chooses voice input, audio capture, transcription, or another audio feature.
  • File or storage access may be used to open, create, export, import, analyze, or save user-selected content and models.
  • Photo or media access may be used when the user chooses content from a device media library.
  • Notification access may be used for model download status, task completion, application updates, or other user-relevant notices where supported.
  • Network access may be used for downloads, updates, online search, support, remote services, or other features that require internet connectivity.

Users may be able to revoke permissions through operating-system settings. Revoking a permission can prevent the related feature from functioning.

Local Files and Storage

OpenMindAI may create local application data such as settings, logs, model files, model metadata, conversation history, indexes, caches, temporary files, generated content, or other working data.

The exact storage location can depend on the operating system, installation type, user-selected storage path, application configuration, and platform restrictions.

Users are responsible for maintaining enough free disk space for the application and selected models. AI model files can be large and may require significant storage.

Deleting the main application does not always remove every user-selected model, exported file, or custom storage directory. Users should review application settings and operating-system storage locations if they want to remove associated data completely.

The user is responsible for backups of important locally stored content unless OpenMindAI expressly provides and confirms a backup feature for that content.

Model Downloads

OpenMindAI may offer model discovery or download features. A model download can require a substantial amount of bandwidth and storage.

OpenMindAI may display model size, source, quantization, compatibility, license information, checksum, or other metadata where available. Such metadata is provided to assist the user but may depend on information from third-party sources.

The application may verify downloaded files using checksums, signatures, metadata, or other integrity checks where supported. No integrity mechanism can guarantee that every third-party model is free from defects or hidden risks.

Users should download models only from trusted sources. Manually replacing a verified model file with an unverified file can affect security, performance, and behavior.

OpenMindAI may block or warn about a download if a source is unavailable, the expected hash does not match, the model is incompatible, or a security concern has been identified.

Internet Connectivity and Data Charges

Some OpenMindAI features require internet access. The user is responsible for internet availability and any data charges imposed by a network provider, mobile carrier, internet service provider, or other service.

Large model downloads can consume significant bandwidth. Users on metered or mobile networks should review download size before proceeding.

An interrupted download may need to resume or restart depending on the feature and platform. OpenMindAI does not guarantee recovery from every interrupted transfer.

Offline operation may remain available for installed local features even when online services are unavailable, but this depends on the model, platform, licensing requirements, and application configuration.

Updates

OpenMindAI may provide application updates, security fixes, runtime updates, compatibility changes, model-catalog updates, or documentation changes.

Updates may be delivered through an application store, an installer, a built-in updater, or another authorized distribution mechanism depending on the platform.

Users should install security updates within a reasonable period when they affect application safety, dependency vulnerabilities, model integrity, or compatibility.

An update may change system requirements, remove deprecated behavior, change the model catalog, modify a user interface, add a permission requirement for a new feature, or discontinue support for an obsolete operating system.

OpenMindAI will use reasonable efforts to avoid unnecessary disruption but does not guarantee indefinite compatibility with every historical device, operating system, model, plugin, integration, or configuration.

Availability and Service Changes

OpenMindAI may be unavailable temporarily because of maintenance, platform outages, third-party provider failures, certificate issues, distribution-store problems, security incidents, network failures, or other events.

Local features may continue to work when remote services are unavailable, but remote features can depend on external systems outside OpenMindAI's control.

OpenMindAI may discontinue a remote endpoint, integration, model catalog, update service, or other online function when reasonably necessary.

If a material online feature is permanently discontinued, OpenMindAI may provide notice through the application, website, release notes, or another reasonable channel where practical.

Support

Support information is available through https://openmindai.vercel.app/contact.

OpenMindAI may request diagnostic information, reproduction steps, screenshots, log extracts, model information, device information, or application settings when needed to investigate a problem.

Users should remove unrelated passwords, API keys, private documents, personal data, or confidential information before sending logs or screenshots unless that information is specifically necessary and the user is comfortable providing it.

Support is provided on a reasonable-efforts basis. OpenMindAI does not guarantee a particular response time unless a separate written agreement expressly provides one.

OpenMindAI may be unable to support unofficial forks, modified application binaries, unsupported operating systems, incompatible models, altered runtimes, compromised devices, or third-party components not distributed or recommended by OpenMindAI.

Security

OpenMindAI aims to use reasonable technical and organizational safeguards appropriate to the product and its architecture, but no software can be guaranteed completely secure.

Users are responsible for securing their own devices, operating systems, accounts, API keys, local files, backups, and network environments.

Users should keep operating systems and security software reasonably current, use trusted download sources, avoid running unknown executables with elevated privileges, and protect devices with suitable access controls.

Security vulnerabilities affecting OpenMindAI may be reported through https://openmindai.vercel.app/contact.

Users should not publicly disclose a vulnerability in a manner that unnecessarily exposes users to immediate harm before OpenMindAI has had a reasonable opportunity to investigate, unless applicable law or an established responsible-disclosure process requires otherwise.

Prohibited Interference

Users must not intentionally disrupt, overload, attack, or abuse OpenMindAI-operated online services or distribution infrastructure.

Users must not knowingly bypass access controls used to protect a publisher-operated service, falsify requests to impersonate another user, or exploit a vulnerability for unauthorized access.

Legitimate interoperability testing, security research, and defensive analysis remain permitted where lawful and appropriately authorized.

Accounts and Credentials

Some OpenMindAI features may not require an OpenMindAI account. Optional integrations may require a third-party account or credential.

If OpenMindAI introduces an account-based feature, users will be responsible for maintaining accurate account information and protecting credentials from unauthorized use.

A user who believes an account, token, API key, or integration credential has been compromised should revoke or rotate it through the appropriate provider and contact OpenMindAI if the issue involves OpenMindAI-operated infrastructure.

Users must not share credentials in a way that violates the applicable provider's terms.

Fees and Paid Services

OpenMindAI may be offered without charge, may include optional paid features, or may rely on third-party services that impose their own fees.

Any OpenMindAI fee, subscription, purchase, or paid feature should be disclosed before the user commits to payment.

Third-party API usage fees are the user's responsibility when the user connects the user's own paid account or API key.

Refund rights, cancellation rights, taxes, billing rules, and payment processing may depend on the application store, payment provider, country, and mandatory consumer law.

OpenMindAI will not treat a third-party model as unrestricted merely because the model can be downloaded without payment. Model licensing remains separate from price.

Advertising and Sponsorship

If OpenMindAI introduces advertising, sponsorship, affiliate links, or paid placements, such commercial relationships should be identified where required by law or platform policy.

A sponsored placement should not be represented as an independent technical conclusion if sponsorship materially influenced its placement.

Third-party advertising systems, if introduced, may involve additional privacy disclosures and consent requirements. OpenMindAI should update its Privacy Policy before enabling materially different data practices.

Intellectual Property Complaints

OpenMindAI respects intellectual-property rights.

A rights holder who believes that OpenMindAI-hosted material, OpenMindAI-authored content, or a publisher-controlled distribution asset infringes rights may submit a complaint through https://openmindai.vercel.app/contact.

A complaint should identify the protected work, the allegedly infringing material, the basis of the claim, the complainant's authority, and reasonable contact information.

OpenMindAI cannot adjudicate ownership disputes over content that exists only on a user's local device and is not controlled or distributed by OpenMindAI.

Third-party model training disputes or third-party repository content may need to be directed to the relevant model creator, repository host, or service provider where OpenMindAI does not control the challenged material.

Trademarks and Brand References

OpenMindAI and associated original branding may be protected under applicable trademark, unfair-competition, and related laws.

Users may make truthful nominative references to OpenMindAI, including reviews, academic discussion, compatibility descriptions, tutorials, and criticism, subject to applicable law.

Users should consider battery level, heat, storage capacity, mobile data usage, and device performance before running large models or extended inference sessions.

Desktop Application Terms

Microsoft Store Distribution

When OpenMindAI is obtained through the Microsoft Store, the user's relationship with Microsoft for Store access, acquisition, installation, updates, billing, and other platform services is also governed by Microsoft's applicable terms.

OpenMindAI, not Microsoft, is responsible for the OpenMindAI application's functionality, product support, privacy disclosures, and publisher-controlled content unless Microsoft expressly assumes a responsibility under its own terms.

OpenMindAI may disclose in Store metadata that the application uses generative AI and may provide a mechanism for users to report inappropriate AI-generated content.

If Microsoft Store rules or mandatory law give a user additional rights concerning refunds, cancellation, repair, replacement, privacy, or product quality, these Terms do not reduce those rights.

Microsoft trademarks and services remain owned by Microsoft. Distribution through the Microsoft Store does not make Microsoft the creator of OpenMindAI.

Google Play Distribution

When the OpenMindAI mobile application is obtained through Google Play, Google Play terms and applicable Google policies may also govern distribution, installation, billing, account use, updates, and other platform functions.

The user remains responsible for any third-party subscriptions, API accounts, or external services connected to OpenMindAI and must cancel those directly with the relevant provider when necessary.

Provisions that by their nature should continue after termination, such as intellectual-property rules, warranty disclaimers, liability provisions, and dispute-related terms, may survive termination to the extent permitted by law.

Termination by OpenMindAI

OpenMindAI may discontinue the application or a publisher-operated service, subject to mandatory legal obligations.

OpenMindAI may also remove a model, integration, download source, or feature without treating that action as termination of the entire application.

OpenMindAI does not guarantee that a third-party model, library, API, download source, operating-system component, or external service will remain available or unchanged.

Some jurisdictions provide implied warranties, statutory guarantees, consumer remedies, or other rights that cannot be excluded. Nothing in these Terms removes rights that applicable law does not allow OpenMindAI to waive.

Limitation of Liability
